1694 Capiatur Fine Ac An Act to take away the Process for the Capiatur Fine in the several Courts at Westminster.
London: 1694. Booklet - Unbound Pages. Very Good Condition. Item #364127
In the shadowed corridors of civil litigation, the capias pro fine had long been a tool ripe for exploitation, used less for order than for opportunism. This Act struck a decisive blow against the murky custom of levying arbitrary fines on defendants post-judgment. Instead of perpetuating fees that vanished into the coffers of court officers, it established a clear and modest cost, six shillings and eightpence, payable by the victor and recoverable within costs. The reform revealed a maturing legal system, one increasingly intolerant of opaque practices and more attuned to fairness and procedural transparency. 2 pages, and cover page with royal crest. Really quite browned. An authentic standalone act of parliament, extracted from a larger volume. Not a reprint or reproduction, but an original work in its own right. Supplied without title page or cover. Size: 17 x 27 cms. Category: Parliamentary Acts::William 3rd; Printed before 1700;.
