O'Brien was arrested in 1840 and charged with making a seditious speech in Manchester. Convicted of sedition, he served eighteen months in Lancaster Prison. Upon release he disagreed with Feargus O'Connor regarding Physical Force Chartism and parliamentary elections. O'Brien wanted to have Chartist candidates whilst O'Connor preferred to attempt to pressure the Whig government by encouraging votes for Tory candidates. 14 pages, printed in double columns. A trial from the Reports of State Trials, New Series, 1892, published in facsimile, 1982.
